Unlawful Possession of a Controlled Substance is committed when a person possesses any of the substances listed in the state’s controlled substances schedules (including, for example, cocaine, heroin, and methamphetamine). Ala. Code 13A-12-212. Possession of a Controlled Substance is a Class C felony.

Possessing a higher amount of a controlled substance makes it more likely that you will be charged with a felony. In Alabama, possession of a substance over a certain amount will shift the charges from a misdemeanor to a felony.

On first offense, possession of drug paraphernalia is a Class A misdemeanor carrying up to a year in prison. Any subsequent offense is a Class C felony punishable by one to ten years in prison. Delivering paraphernalia to a minor who is at least three years younger than you is a Class B felony carrying 2 to 20 years.

In Alabama, the criminal penalties depend on what type of controlled substance a person is convicted of possessing and whether the individual has a prior conviction. First time offenders arrested with an amount that would be considered “personal” are less likely to serve jail time, especially with a proper legal representation. However, if you are being charged with possesion with intent to distribute, even if it is your first time, you will likely serve jail time. Your only recourse is to speak with a knowledgeable attorney to see if there are weaknesses in the prosecutor’s case.

This can get you between 1 and 10 years in prison and up to a $15,000 fine. Possession of pot for personal use is only a Class A misdemeanor (the highest misdemeanor in Alabama). This is possession in the second degree. A Class A misdemeanor can be sentenced to not more than a year in jail and up to a $6,000 fine.

(a) A person commits the crime of unlawful distribution of controlled substances if, except as otherwise authorized, he or she sells, furnishes, gives away, delivers, or distributes a controlled substance enumerated in Schedules I through V. (b) Unlawful distribution of controlled substances is a Class B felony.

The defense of a person charged with possession of controlled substance is often difficult, but not impossible. In Alabama, if a prosecutor fails to provide materials during discovery it is possible to seek dismissal of the charges as a sanction against the state.

Any person found in possession of a drug or medicine limited by law to dispensation by a prescription, unless such drug or medicine was lawfully dispensed, shall be guilty of a misdemeanor and, upon conviction, shall be fined not more than $1,000 and, in addition thereto, may be imprisoned in the county jail for hard labor for not more than one year.
