Alabama Code Section 32-5A-191 outlines what qualifies as driving under the influence. You can be charged with DUI if you are:

  • Operating a vehicle with a blood alcohol concentration of 0.08 percent or more

  • Incapable of driving safely due to any impairing substance

Drivers under the age of 21 and those operating certain types of vehicles have stricter limits, just 0.02 percent.
